The Executive Master of Laws (LL.M.) in Banking and Financial Market Law offers specialised legal training, fully tailored to the requirements of the LI-D-A-CH region. Intensive Courses

The Intensive Course on Banking Law provides participants with essential foundations of European banking law, from both a civil law and a regulatory perspective. Starting with licensing and authorisation requirements, the course explains the key supervisory instruments on the side of the authorities, as well as the corresponding and general conduct obligations for banks.

The course also examines common banking business models and places them within the relevant legal framework. A significant part is devoted to the regulatory provisions of the Capital Requirements Regulation (CRR) and the legal questions surrounding bank resolution, recovery or restructuring.

The Intensive Course on Digitalisation and Sustainability offers practical insight into the regulation of digital business models in the financial market. The focus is on key FinTech trends such as cryptocurrencies, robo advice, algorithmic trading, and crowdfunding and P2P platforms. Particular attention is given to current EU platform regulation (DMA, DSA) and its impact on banking and financial market law. In addition, the course explores interfaces with European data protection and commercial law. In the area of sustainability, the emphasis is on the European legal framework for sustainable finance – in particular the Taxonomy Regulation, CSRD, CSDDD and the Disclosure Regulation. The six-day course is rounded out with topics such as sustainable lending and investment advice under MiFID II (including Delegated Regulation 2021/1253).

The course covers the law of collective investment schemes. It discusses key regulatory provisions contained in the Act on Certain Undertakings for Collective Investment in Transferable Securities (UCITSG), the Act on Managers of Alternative Investment Funds (AIFMG) and the Investment Undertakings Act (IUG).

Particular attention is given to the regulatory requirements for management companies and depositaries. The course also addresses European special regimes for money market funds, European venture capital funds (EuVECA), European social entrepreneurship funds (EuSEF), European long-term investment funds (ELTIF) and pension funds. Finally, it examines the tax framework conditions for fund structuring and fund management.

Not only must they maintain an overview of all relevant rules, but they must also be able to identify and prevent misuse for the purposes of money laundering or terrorist financing at an early stage.

The requirements for the role of the due diligence officer have also increased rapidly in recent years and will continue to do so. To keep pace, it is essential to develop broad, interconnected knowledge.

The Intensive Course on Due Diligence Obligations is delivered in cooperation with the FMA Financial Market Authority Liechtenstein and CLL Compliance Labs Liechtenstein. This event is recognised as professional training and professional education under Art. 21 SPG in conjunction with Art. 32 SPV, and as evidence within the meaning of Art. 36 SPV for a total of 3 days.

DORA – Simplified ICT Risk Management Framework for Asset Management Companies

The Digital Operational Resilience Act (DORA) sets requirements for digital operational resilience. Article 16 DORA, invoking the principle of proportionality, provides that certain financial firms – including Class 3 investment firms such as asset management companies – are subject to a “simplified ICT risk management framework” compared to larger financial institutions.

Certain aspects of this simplified framework have also been detailed in a Delegated Regulation (2024/1774). This themed evening offers an introduction to the IT risk supervisory regime under DORA, provides insight into the regulatory simplifications for asset management companies and examines the extent to which the principle of proportionality is actually applied.
